Lawyers Not Behaving Badly

This month I had the pleasure of examining a Networking Forum that spans the globe. You might think that lawyers speaking in many tongues would be confusing but there is a collaborative effort in place.

The ILN (International Lawyers Network) Regional Meeting of the Americas took place this summer. It was reported that the Network has almost 90 firms, with approximately 5,000 lawyers. As the Network has grown dramatically, its focus has moved from being one of only referral development to one where the ILN looks to help member firms to expand the reach of their firms. Lowell noted that this would be a theme throughout the Regional Meeting of the Americas and said that as the ILN works towards implementing a strategic plan for thenext few years, having an international link that can be used for marketing and as a real tool for clients will be important.

Then came a discussion of the referral activities of the Network. It was noted that referrals are an
important component of the ILN, and a discussion of the referral report is a way to understand some of their value.

The most recent referral report covered the period of January to July 2008, which showed an increase in referrals.

It was stated, however, that it is still difficult to obtain accurate referral information, but said that the report serves
as a gauge to show a continual increase across all regions. It was also stated that inter-regional referrals continue tobe the most active, which reinforces the importance of regional meetings. It was estimated that
the figures are under-reported by at least three times based on his conversations with members about referrals
that are never officially reported. Yikes..

Corporate referrals remain the highest category of types that are referred, followed by litigation, tax, labor and employment and real estate.

The monetary value of the referrals is a difficult number to assess, as many of the reported referrals show only the initial estimate, which is often very low. The ILN doesn’t have a method for capturing the future value of the referral as of yet, and so the majority of the referrals appear in the smaller valued bracket. The total valued is also believed to be under-reported, and a conservative estimate is that the total referrals could be $7.5-$10 million per six monthperiod.

Keeping track of referrals, especially in the larger firms, is very difficult and members are asked to work closely with the contact person at their firm to ensure that the firm has some knowledge of thereferrals that are occurring.

The offices of the ILN can offer to the members, another service, which is a referral from a lawyer that obtained a judgment in a community and needed to enforce the judgment in four or five locations. One method of handling this would be to go to each of the ILN contacts there and asking each of them to handle it, but a more effective way of handling this is to go directly to ILN, itself, and have it delegated appropriately.

ILN would simplify the process by getting those locations squared away and ensuring that the job gets done,
acting as the facilitator on a multi-jurisdictional problems.

The ILN officers had visited over 20 firms in 2007/2008, which he noted is a very important part of its recruitment.

The response is tremendous, even at firms who are knowledgeable about the ILN, because it gives the partners a chance to sit down with the organization.

It should be added that the referral request is a six month snapshot, as an example, a referral will come in and will develop only $5,000 worth of fees by the time the request is circulated, but could turn into $150,000 matter over the next year. The referral report doesn’t capture to what extent the referrals lead to additional business from that client or relationship and that the ILN has worked to come up with different ways to capture the data. The ILN
Administration can accept referral reports at any time and reflect that approximately 20% of the referrals lead to ongoing client relationships, which is a significant amount.

Another way that ILN members are beginning to use the offices of the Administration is to market their services to existing or potential clients to show the global reach of their firm through the ILN. The Administration has been contacted by firms who are having client meetings and would like to express the capabilities of member firms in the jurisdictions where their client does business. When contacted in this regard, the ILN Administration will contact the relevant firms in the group to get the information.

The ILN is proud of their website, saying that it’s a source that all ILN members use, in addition to
their partners and the outside public. Currently, the website has 50,000 hits a month, which is quite substantial.

The statistics that the Administration gets allows them to see which pages people are visiting, and these include
membership information such as the practice areas of firms, as well as the articles that members contribute to the
newsletters. These articles continue to be referenced every day, every month, and even years after the article is
written when the subject becomes relevant again.

This is a powerful, far-reaching organization of lawyers designed and implemented for the benefit of the legal community and their clients.

Lunch Bunch

This month I examined the above attorney networking gathering in Washington D.C.of a random group of solo practitioners who regularly meet for lunch. The group has grown exponentially since its inception but its purpose has not. It's a chance to connect and socialize and network with other solos. Business cards and war stories and referrals are exchanged.

The Lunch began nine years ago by a request to the ABA's Solo Attorney department asking if anyone in the D.C. area wanted to get together for lunch. These lawyers meet monthly since that point. The group has grown to over 160 members with about 35 lawyers meeting every month in an informal, non-threatening setting. Many valauble referrals have been given/gotten and more importantly, clients have been served successfully. The huge range of practice areas means there is always a fellow attendee who can refer a client or take on a compelling issue and there is always an authority in a legal topic.

Very recently the Lunch Bunch had their first guest speaker, Maryland Attorney General Douglas Gansler. He spoke concerning his office's goals and accomplishments. This was a seminal moment for the group. It is anticipate that additional important speakers will attend the meetings and the group will gain in membership and stature and will continue its strong networking benefits.

Minority Lawyers Network

This month I researched and gained exposure to the NACN. The "Home of America's Best and Brightest Attorneys of Color".

The mission of the National Attorney of Color Network ("NACN") is to promote diversity in the legal profession by: (i) providing corporate America and leading law firms with access to the brightest attorneys of color; (ii) creating enhanced employment opportunities for attorneys of color through the power of networking; and (iii) providing an efficient means for the communication of successful diversity strategies in the legal profession.

The NACN was organized by a former African-American partner of a prominent national law firm based in New York City. His commitment to diversity in the legal profession led him to create this network. Based in New York City, the NACN strives to work with existing organizations that are also committed to improving diversity in the legal profession.

Members of NACN search and apply for job openings posted on the NACN website and submit/update their profile regarding their experience and education. Members get e-mail alerts of job openings from companies and law firms. Members are able to meet practicing attorneys at regional and national networking events for law students and attorneys of color. Mentoring of law students of color is possible or students can be mentored by a practicing attorney of color. Attorneys of color share, and are advised of, successful career and diversity strategies and most importantly, access the valuable information provided in the resource centers.

In addition, membership in the NACN also assists law firm associates and partners in their business development efforts by making them more visible to corporate legal departments seeking to identify and hire outside counsel.

As an employment search portal the NACN is exclusively for attorneys and law students of color. The NACN offers a state-of-the-art search engine that permits employers to conduct targeted searches of the candidates in the NACN database based on a host of criteria, including, law school attended; undergraduate school attended; GPA; practice area expertise, number of years of experience; law school rankings, honors and even ethnicity. The searches will produce candidates who possess the qualifications for which the employers are looking. The NACN protects the identity of its members. A member's identity will be released to a potential employer, only if the member expressly authorizes the NACN to do so.

There are events nationwide to allow for the connection of attorneys of color to others in the legal profession. Overall, the NACN is a very important organization for the career advancement of the attorney of color within the legal profession.

Matthew Radin Esq. of Liberty Legal Plans

This month I had the pleasure of meeting with and interviewing Matthew Radin Esq. of In House Legal Support Services and Liberty Legal Plans, based in Commack N.Y.

LawGuru

This month I reviewed a web-site named www.lawguru.com. This site comprises an online community of over five-thousand (5000) attorneys in the U.S. maded up of solo practitioners and law firms.

The purpose is to gain exposure for an attorney's firm by reaching new clients by providing information and to be seen as a resource in their practice area. All members automatically get legal questions from potential clients in all specialty areas and geographic location. Further, there is ample opportunity for attorneys to network with other attorneys beyond their professional scope and state boundaries. This is a valuable chance to create relationships within the profession...

The parent organization, based in N.Y, N.Y. was founded in 1955. The association exists for members of the legal profession from Italian-American descent.

"Web 2.0 Bill of Rights?" from Madisonian.net

If you’re a student, professor, or lawyer of a certain age, you may feel a need to be on some social networking site–be it Facebook, Linked-In, or even MySpace. You might want to create one site for your friends, and another for your professional colleagues. But before jumping on, consider the business plan of a data scraper like RapLeaf:

Rapleaf [is] a people search engine that lets you retrieve the name, age and social-network affiliations of anyone, as long as you have his or her e-mail address. . . . Upscoop.com [is] a similar site to discover, en masse, [the] social networks to which the people in your contact list belong.

There’s a nice discussion at Crooked Timber. The bottom line is that you take a calculated risk when joining these sites. Even if you don’t create ”bad news that follows you,” you at least generate opportunities for the nosy to unearth all manner of communications, opinions, and likes you happen to make public.

Law and Letters: Facebook, Social Network Theory, and Playing Scrabble

Law and Letters: Facebook, Social Network Theory, and Playing Scrabble

Just yesterday, Just A Law Prof asked me:

1. What is the point of Facebook
2. Why would anyone want to broadcast his or her personal details and private information to strangers, and why would we care about someone else's business?
3. What are the rules of etiquette for Facebook? Must you "friend" (v., transitive) someone you've only met once? What about students?


My take:

As Rick Bales says, don't be so quick to knock thes social network power of Facebook. For more on this, read Danah Boyd's work on social networking sites. Danah Boyd is a PhD candidate at the School of Information at Berkeley and a fellow at the Harvard Berkman Law & Technology center.

I really don't like certain aspects of exhibitionism on Facebook. But I understand its social network appeal. I've been learning a lot about organizational behavior and social network theory in the context of employment networks, and so to me this is just the division between the real world vs. the virtual world, rather than a generational gap (although that's articulated in other ways on Facebook).

The Milgram Small World Experiment set to demonstrate that we are no more than six degrees separated from anyone else in the world. If I had to get a package to another person in another state, and did not know that person, I would have to think of people I know who might know that person, or extend the chain to add a link. It's that "I know a guy who knows a guy who knows a girl who...." joke.

(Legal) Networking Means Showing Up

Yesterday, I gave a presentation on technology and the lawyer for the Mass. Bar’s Lawyer’s in Transition seminar. It was a very interesting program, designed for people that had been out of the workplace and were looking to get back on the ‘lawyer track’.

Most of the people had been out of the legal field for 2–5 years, some a bit longer. The most common reasons for being out of the work filed were raising children, elder health care or personal health problems. It seemed like half of the people were thinking of going the sole practitioner route.
